Under state law, arrest records do not contain elements that determine or confirm a detainee's guilt. Arrest records only address the circumstances and facts related to the arrest and detention. Basic arrest information can be accessed by anyone in the county or through the Stark County Sheriff’s Office. There is also the provision of the Ohio Revised Code § 109.57, which allows the Bureau of Criminal Identification and Investigation to maintain a statewide record of fingerprint-based records that are accessible to authorized individuals only. This is because they are more detailed records that contain the detainee’s offender history. 

Arrest records are also generated and maintained by pubic agencies such as the courts, jails, and local police departments. The two largest police departments in the county, the Canton Police Department and Massillon Police Department, may maintain their separate arrest records for the cities they serve, Canton and Massillon, respectively. However, individuals who are arrested by these police departments will be transferred to the county jail under the Sheriff’s Office jurisdiction as soon as possible.

Yes, arrest records are publicly accessible in Stark County according to the provisions of the Ohio Revised Code (ORC) § 149.43. This law provides that public records, such as arrest records, maintained by law enforcement agencies are classified as public records that can be requested and inspected by the public. There is generally no need for identification, except that the nature of the request requires it or a copy fee is being charged. These agencies also maintain online platforms where the public can access statewide arrest information. The Department of Rehabilitation and Correction maintains an Offender Search tool, which allows search by name, number, and status. 

Members of the pubic can also access information for locations where background checks can be done through the Ohio Attorney General’s Background Check website. Federal resources are available through the Federal Bureau of Prisons. This agency’s free Inmate Locator provides nationwide access to information about detained or imprisoned individuals.

Stark County inmates can be found through the sheriff’s office or the county jail. The public can approach the jail or sheriff’s office with a request in person. This office can also be contacted over the phone by calling 330-430-3800 for the sheriff’s office or 330-430-3850 for the county jail to confirm if an individual has been detained. The sheriff’s office does mot maintain a dedicated online roster. This means the public will use the state’s Offender Search tool for online access to inmate records. Active Warrant Search in Stark County

Arrest warrants are formal legal documents that are issued by a magistrate, a judge, or other authorized court officials. This document directs law enforcement agents to arrest and detain a named individual for a named offense. Arrest warrants can also be issued to prevent a crime from being committed. Stark County arrest records can be accessed for free through the state and county tools. The public can approach the sheriff’s office, a local police department, or the county courthouse to request and inspect arrest records for free. This will simply require some details about the detainee or arrest for an archive search. The county maintains a Criminal Justice Information System, which provides free docket search access to individuals using the website as a guest. 

Simply enter the relevant detainee name or case number on the portal to access the county’s law enforcement records. Ohio also provides an ODRC Offender Search tool, which provides statewide access to law enforcement records. The public must note that free access to arrest records usually involves recent or current records. This means that older arrest records from years ago may not be available without an official records request. Redacted or sealed records, such as juvenile records, will not be available on these public platforms.

Stark County Arrest Report

Stark County arrest records are different from arrest reports. An arrest record is a database entry that represents a formal notation in law enforcement and court systems of a named individual being detained. This record generally contains booking details and certain court filings, such as arraignment documents. Arrest records are limited to providing specific details, while an arrest report is a narration of the arrest circumstance. Arrest reports refer to the arresting officer’s firsthand account of how the arrest was executed. are written by the arresting officer after the detention is complete. This document may also be referred to as a police or incident report. These documents are generally maintained separately and can be accessed through different channels. Arrest records may be obtained through the CJIS portal, by phone, or in person. 

Arrest reports are accessible through the arresting agency, the sheriff’s office or a local police department. Unlike arrest records, which are publicly accessible, some sections of an arrest report may be redacted due to the extra details they contain.

How to Get an Arrest Record Expunged in Stark County

Arrest records can be cleared in Stark County by sealing or expungement according to Ohio Revised Code §§ 2953.31 through 2953.61. This law allows qualified individuals to remove their arrest records from public archives, which is sealing, or a permanent destruction of the records, which is expungement. Individuals who were arrested without a conviction can seal or expunge the records immediately after the case is dismissed or they are discharged. According to Ohio laws, individuals who wish to seal or expunge their arrest records must meet these conditions:

  • If convicted of a misdemeanor, offenders can become eligible for sealing and expungement after 1 year from the final discharge
  • If convicted of lower-level felonies, offenders will become eligible for sealing after 1 year from the final discharge
  • Offenders convicted of F3 felonies can seal up to 2 convictions after 3 years from the final discharge
  • Felony convictions generally have a 10-year waiting period for eligibility.

Individuals who are convicted of offenses such as first-degree and second-degree felonies are ineligible for expungement or sealing of records. Other offenses that make offenders ineligible include DUI convictions, sex offenses that require registration as a sex offender, domestic violence convictions, and crimes involving underage victims. The sealing or expungement process can be initiated by filing a petition in the court where the case was handled. Applicants will pay a non-refundable $50 filing fee, which can be waived for indigent applicants. 

How Do You Remove Stark County Arrest Records From the Internet?

Stark County arrest records can be removed from the internet through the sealing or expungement process. The first step is to obtain the court order, which will be the legal basis for your removal requests according to  Ohio Revised Code § 2953.32. This law prevents government agencies from disclosing sealed records to the public. Relevant agencies such as the sheriff’s office and local police department will be served the court order after which the record will be removed. This court order applies to taking down records on the internet for sealing and will extend to hard copy records for expungement.
